Shaklee Corp. accused of using Healthprint mark without authorization

OCALA – A Florida corporation alleges a California-based multi-level marketing company is using its trademark without permission.

Superior Consulting Services Inc., doing business as Future Health and YFH, filed a complaint on Nov. 1 in the U.S. District Court for the Middle District of Florida, Ocala Division against Shaklee Corp. alleging trademark infringement.

According to the complaint, the plaintiff alleges that since Nov. 5, 2002, it is the sole owner of the “Healthprint” mark. It alleges that the defendant was using its registered mark to sell its recently launched services that directly competes with plaintiff’s services without license or authority from plaintiff.

The plaintiff holds Shaklee Corp. responsible because the defendant allegedly caused confusion among consumers by offering similar services and using the same marks as plaintiff’s distinctive marks, to capitalize and receive the benefit of plaintiff’s reputation and goodwill.

The plaintiff requests a trial by jury and seeks judgment against defendant, enjoin defendant from further infringement, damages, seize and destroy infringing materials, attorneys’ fees, costs and further relief available at law. It is represented by Coleman W. Watson of Watson LLP in Orlando.
